Mobile Message Service Terms and Conditions

ZAGS® ("We," "Us," "Our") offers a mobile messaging service (the "Service"). Your use of the Service constitutes your agreement to these Mobile Terms and Conditions (“Mobile Terms”).

We may modify or cancel the Service or any of its features at any time without notice. We may also update these Mobile Terms, and your continued use of the Service following the effective date of any such changes constitutes your acceptance of those changes.

We do not charge for the Service, but you are responsible for any message and data rates imposed by your wireless provider. Message and data rates may apply.

The Service allows users to receive SMS/MMS mobile messages by affirmatively opting in, such as through online or application-based enrollment forms. Regardless of the method used to opt in, you agree these Mobile Terms apply to your participation. Messages may be sent using an automatic telephone dialing system or other technology. Your consent to receive autodialed marketing messages is not required as a condition of purchasing any goods or services.

If you opt in, the Service may send you updates, alerts, information, promotions, specials, and other marketing offers (e.g., cart reminders) via text message to the mobile number you provided. Message frequency may vary.

To opt out, text STOP to 1 (844) 946-2864 at any time. You will receive a one-time confirmation message. You agree that texting STOP is the only reasonable method of opting out, and any other attempt (such as different keywords or verbal requests) is not valid.

If you have subscribed to other ZAGS® messaging programs, you must opt out of each individually by following the opt-out instructions specific to that program.

We may change the phone number or short code used to operate the Service at any time and will notify you of such changes. You understand that messages sent to an outdated number or short code may not be received, and we are not responsible for honoring such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number and to maintain accurate, up-to-date information related to your receipt of messages, including promptly notifying us of any changes to your mobile number.

You agree to indemnify, defend, and hold us harmless from any third-party claims, liabilities, damages, or costs resulting from your use of the Service or from providing a mobile number that is not your own.

You may not use or engage with the Service if you are under thirteen (13) years of age. If you are between thirteen (13)and eighteen (18) years old, you must have permission from a parent or legal guardian. By using the Service, you represent that:

  • You are not under the age of 13;

  • You are at least 13 years old and have parental/guardian consent, or;

  • You are of legal adult age in your jurisdiction; and

  • Your use complies with all applicable laws in your jurisdiction.

We are not liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, or for any action you take (or do not take) in reliance on messages sent through the Service.
